Finn IP Law, PC

Intellectual Property (IP) is a key driver of today's tech-driven economy. Whether your objective is: to create new IP assets or (e)valuate what you have, to prevent or stop unlawful activity that violates your rights or defend against such accusations, to stay out of IP-related trouble, or any combination of the above, we can help. The firm's IP capabilities are broad and deep and include:

Patent Law

From asserting your patents or defending against infringement claims - to representing your company in the U.S. courts and Patent & Trademark Office (USPTO) - to all deal-related things between, including portfolio management, patent evaluations, transfer and licensing, and dispute avoidance, Finn IP Law can expertly handle virtually any of your patent related issues. The firm takes pride in staying at the cutting edge of patent law - indeed, at times even influencing the law. The success record of the founder of Finn IP Law in the courts and USPTO speaks for itself.

© & ™ Protection

Protecting non-functional works - from the arts to software - (copyright) and company brands (trademarks) create significant value for many companies. Early adoption of an IP strategy into a client's product (or service) development cycle can increase the prospects for value creation and help avoid IP problems. It is this kind of proactive, business-minded approach to IP law that is a hallmark of Finn IP Law's legal practice.

Trade Secret Law

With the passage of the Defend Trade Secrets Act (DTSA) in 2016 creating a federal cause of action for civil trade secret misappropriation (complementing the existing state law regime), trade secrets have never been a more important tool in a U.S. company's IP toolbox. This is particularly true in the software space, where patents rights have as late been severely curtailed. Having litigated both technology and ex-employee type trade secret cases, advised on and devised strategies incorporating trade secrets, Finn IP Law has the experience and insights to help you navigate this area of law and its intersections with other IP domains.

AIA Practice

The America Invents Act’s (AIA) post-grant review procedures are proving to be powerful tools for leveling the non-practicing entity (NPE) playing field and for bringing more balance to the patent system. Finn IP Law has the expertise to help you devise, evaluate and if appropriate implement a cost-effective AIA strategy, whether in parallel with or in place of district court actions.

Start-up IP/IT Work

Finn IP Law advises on all aspects of IP matters, including start-up advisory work, drafting and negotiating licensing, IT, software and confidentiality agreements, M&A deals and public offerings, IP portfolio sales, product rollouts, and bankruptcies. Our firm can be as innovative as the start-ups it serves when it comes to its work and fee structures.

Ancillary IP Services

Finn IP Law is a great resource for shadowing IP projects and other cases; providing "sanity checks" on business direction; evaluating business plans from a legal perspective and assisting with public filings and diligences.

FinTech

A significant part of Finn IP Law's practice involves services to the banking and payments industries. Expertise includes: e- and alt- payments, mobile and image capture front-end systems, back-end clearing and settlement, cash sweeps / insured deposits, customizable securities and indexes, and cutting-edge technologies such as crypto-currencies.

Jeffrey A. Finn

Jeff Finn is a seasoned technology lawyer serving start-up, emerging growth and multinational corporations. He approaches his practice with single-minded focus: to help his clients meet their business objectives in the most efficient manner.

Jeff’s expertise in the field of intellectual property law is wide and deep.  Leveraging his background as an electrical engineer, his substantial litigation, counseling and licensing experience, and USPTO and Federal Circuit practices cross industries and technologies as varied as mobile hardware and apps; cryptocurrencies, e-payment and banking systems; information technology systems; wireless communications (e.g., GSM, LTE, satellite, microwave/millimeter wave) hardware, software and standards; computer and processor architecture; location-based services (LBS); and medical diagnostic and therapeutic technologies.

Jeff has handled many significant, cutting-edge, litigation matters that are important to his clients and to the patent bar, including arguing, in a case of first impression before the Federal Circuit, the standard for patent prosecution bars and arguing in the context of Markman and “on-the-pleadings” hearings the patentability of computer-implemented business method patents under 35 USC § 101.  The strategic use of the America Invents Act’s post-grant review procedures in parallel with district court actions, transferring cases out of “rocket docket” jurisdictions and providing cost-effective representation of multiple defendants in suits brought by non-practicing entities (NPEs), are other examples of how he uses the law to help his clients.

Jeff also advises on all aspects of IP matters, including start-up advisory work, drafting and negotiating licensing, IT, software and confidentiality agreements, M&A deals and public offerings, IP portfolio sales, product rollouts, and bankruptcies. Examples of such counseling include portfolio evaluations, licensing in and out, due diligence, and opinions.

Jeff has served as an editor of the Practising Law Institute (PLI) treatise, Patent Litigation, and has authored numerous intellectual property-related articles and primers for high-tech companies. He has spoken and written on cutting-edge patent issues for Continuing Education of the Bar – California (CEB), PLI and state bar associations, and is a past member of the planning committee for the University of Southern California Gould School of Law Intellectual Property Institute. Prior to starting his firm, Jeff was a partner at Sidley Austin, LLP and Katten Muchin Rosenman, LLP.

Jeff, with his wife of almost 25 years, have four daughters, one boy (a dog named Charlie), and a great community of family, friends and colleagues in Los Angeles, CA
